Terms & Conditions

These Terms & Conditions govern your access to The Madison interactive price list, the buyer profile process, and the online reservation of apartments and penthouses developed by Tricolt Group (the "Developer"). By creating a buyer profile, accessing the price list, or submitting a reservation, you confirm that you have read, understood and agreed to these terms.
Your personal information is processed in accordance with our Privacy Policy.
1. Buyer Profile & Access to the Price List
To access the interactive price list and participate in the digital launch you must:
- Complete your Buyer Profile in full and accurately.
- Accept these Terms & Conditions and the Privacy Policy.
- Provide a valid email address and contact number for communication.
The Developer reserves the right to verify the information supplied and to decline access where information is incomplete, misleading or used in breach of these terms.
2. Reservation Process
- Sales launch online at 1pm on Wednesday, 29 July 2026 via the interactive price list. Apartments and penthouses may be reserved on a first-come, first-served basis, recorded by digital timestamp.
- A reservation fee of R20,000 is required to secure a unit, payable within 10 minutes of placing the reservation via Visa or Mastercard, Apple Pay, Masterpass or Snapscan. The reservation is provisional until an Agreement of Sale has been signed.
- The Agreement of Sale will be emailed to the Purchaser and must be signed and returned within 72 hours. Failure to return the signed agreement within the 72-hour period will result in forfeiture of the R20,000 reservation fee.
- Cash purchasers: R20,000 reservation fee; 10% within 3 days after signature; 20% within 21 days after signature; balance payable 6 months prior to occupation.
- Bonded purchasers: 10% within 3 days after seller's signature; bond grant within 21 days after signature; any shortfall due 3 days after bond grant.
- All required documentation in terms of the Financial Intelligence Centre Act, 38 of 2001 ("FICA") must be submitted to the Seller or its appointed agent within 72 (seventy-two) hours of making the reservation.
- In the unlikely event that a unit is double-booked, the buyer whose reservation fee was received first (per digital timestamp) will secure the unit. The second buyer will be offered an alternative unit or a refund of the reservation fee if no suitable replacement is available.
3. Investment of Funds
The Conveyancers are authorised to invest the Reservation Fee in an interest-bearing account in terms of Section 86(4) of the Legal Practice Act 28 of 2014 ("LPA") and approved in terms of the LPA, provided that the Purchaser provided FICA documents. Interest on the investment will accrue to the Purchaser subject to the provisions of Section 86(5) of the LPA which stipulates that 5% of the interest accrued on accounts opened in terms of Section 86(4) of the LPA must be paid over to the Legal Practitioner's Fidelity Fund established in terms of the LPA ("LPFF") and vests in the LPFF. Such investment shall at all times be subject to the Purchaser furnishing all requisite FICA, and signing the necessary authorities to invest as may be required by the Conveyancer.
4. Pricing, Incentives & Discounts
All prices displayed on the interactive price list are inclusive of VAT. Prices and unit availability are subject to change without notice until a reservation has been confirmed.
A R100,000 launch day discount applies to qualifying purchases made on the launch day, subject to:
- The Developer achieving sufficient sales and obtaining all approvals necessary for the registration of The Madison to proceed;
- The Purchaser complying fully with all conditions in the signed Agreement of Sale without the Developer having to issue a breach notice. Should a breach notice be issued, in addition to any other remedies, any value added by the incentive or discount may at the Developer's discretion be billed back to the Purchaser, or any cash incentive may be cancelled.
5. Marketing Material & Imagery
All renders, floor plans, finishes schedules and images portraying The Madison are artist impressions and are intended for illustrative purposes only. Final finishes, dimensions and specifications may vary. The Agreement of Sale and its annexures will prevail in the event of any inconsistency.
6. Communication & Marketing Consent
By accepting these Terms & Conditions, you consent to receive communication from the Developer and its appointed marketing and sales agents regarding The Madison, the digital launch, your reservation and related opportunities. You may opt out of marketing communications at any time as set out in our Privacy Policy.
7. Intellectual Property
All content on this website — including the brand, renders, plans, copy and design — is owned by or licensed to Tricolt Group and may not be copied, reproduced or used without prior written consent.
8. Limitation of Liability
To the maximum extent permitted by law, the Developer and its agents will not be liable for any indirect or consequential loss arising from your use of this website, the interactive price list or the reservation process. Nothing in these terms limits liability that cannot be excluded by law.
9. Governing Law
These Terms & Conditions are governed by the laws of the Republic of South Africa. Any dispute will be subject to the non-exclusive jurisdiction of the South African courts.
